Terms and Conditions

These terms and conditions of use apply to the website, online portal and diagnostic services provided by the Animal Health Diagnostic Center at Cornell University. 

No Warranties

Submitter acknowledges that diagnostic testing or results are inherently variable and cannot be guaranteed. Cornell University makes no representations or warranties, whether express or implied, regarding its testing services or results, including (without limitation) to any warranties related to the marketability, use or fitness for any particular purpose of the results, or non-infringement of any third-party intellectual property rights.    

Risk of Loss; Limitation of Liability

To the maximum extent allowed by applicable law, Cornell University’s aggregate liability arising out of or related to testing services provided through the Animal Health Diagnostic Center (whether under contract, tort, or otherwise) shall not exceed the amount paid for the testing service giving rise to the claim. In no event shall Cornell University be liable for any incidental, consequential or punitive damages of any nature, including but not limited to loss of anticipated profits or other economic loss in connection with the testing services, whether foreseeable or not, and even if notified of the possibility of such damages.  

Jurisdiction

The laws of the State of New York, without reference to choice of law principles, shall apply to all disputes arising from or related to testing services provided through the Animal Health Diagnostic Center, and any and all claims or actions of any nature arising from any such disputes shall be brought in the courts of Tompkins County, New York.

Sample Submissions

Samples must be submitted through a licensed veterinarian. It is Animal Health Diagnostic Center policy not to accept samples directly from animal owners, except for samples tested through Quality Milk Production Services (QMPS). 

Unless previous arrangements have been made, all submitted samples become the property of the Animal Health Diagnostic Center upon receipt and will not be returned. 

Credit and Collections

Billing

The submitter is financially responsible for all testing requested or added to the original submission that is necessary to reach a diagnosis. Please visit our billing page for complete information.

Payment Terms

All Animal Health Diagnostic Center invoices are due 30 days from the date of the invoice. 

Finance Charges

Balances overdue 90 days or more will be subject to a 3.5% finance charge. This charge will be added to the outstanding account balance. Notification of past due balances will be provided monthly. 

Penalties

Active accounts with an outstanding balance over 150 days past due are placed on Credit Hold. Any pending test results will not be released until the full balance due is paid or a satisfactory payment arrangement has been made. Active accounts with overdue balances will be unable to submit samples until payment has been received.
